As the officer approaches, it’s important to be aware of all the consequences you can face for being dishonest. It’s in your best interest to pull over immediately so there isn’t any more suspicion about your driving abilities. 

Steps to Follow When Being Pulled Over

First, you’ll want to slowly pull off into a safe place so the officer can confront you about the issue. As soon as the officer decides to pull you over, there are already observations being made and anything you do will be closely monitored. As always, treat the officer with respect. Police officers are more likely to work with drivers after being treated sincerely and respectfully. They might start to ask vague questions that could potentially lead to a DUI charge, so avoid answering questions without first speaking to a lawyer. 

Remember, one of your Miranda rights is the right to remain silent. If you are pulled over, it is a good idea to invoke this right. Lying will make the situation worse. You are required to give your name, license, registration, and insurance company information when asked. But once you do this, it is a good idea to respectfully invoke your right to remain silent.

Breath Tests and Roadside Tests

If the police officer believes you to be under the influence they will ask you to step out of the car and cooperate with a field sobriety test or breathalyzer. These are voluntary and deciding to not participate in these tests will result in your license being suspended but it will most likely help you during trial with no scientific evidence being used against you. Roadside breathalyzers are well known for being inaccurate. It is relatively easy to fail these tests and gives the officer evidence to place you under arrest, which is what they pulled you over for in the first place. It is a good idea to refuse these tests as well.

Lastly, it’s beneficial to write down anything you can remember from the arrest. The more details that you have to give to your attorney, the more likely they are to help you in your case.
