Consequences

Second DUI convictions for 21 and under offenders can result in the following consequences

  1. Up to two years incarceration, with a mandatory minimum of 120 consecutive days and probation and 100 hours of community service.
  2. A $1,000-4,000 fine.
  3. A 45 days license suspension or until the person reaches the age of 21, whichever is longer. The suspension is automatic and is not subject to review at a per se hearing. This suspension is followed by three years of driving only with a vehicle with an ignition interlock device, including the first year of driving only to work, school, a substance abuse treatment program or an alcohol treatment program, or an ignition interlock service center.

2nd DUI convictions for 21 and over offenders can result in the following consequences:

  3. A 45 days license suspension, followed by three years of driving with a vehicle that is equipped with an ignition interlock device. The first year of driving after the suspension is limited to driving to work, school, or an alcohol or substance abuse treatment program, or an ignition interlock service center. 

Second Offense Difficulties

A second DUI offense is looked at by the Connecticut courts and prosecutors differently than a first offense. This is because it cannot be viewed as simply a one-time mistake. The defendant is not viewed as someone who deserves a warning or a second chance as they may be after a first DUI offense. Because of this, dismissals and programs like the alcohol education program are generally unavailable, and the consequences are much harsher.

Many second offender DUI convictions result in the possibility of jail time, though this is oftentimes suspended. This means that the defendant will probably serve a small amount of jail time, and the rest of the balance of the sentence will be suspended and will only come back into play if the defendant violates probation. What a second DUI offender should expect is a lengthy probation period, as well as a fine that is usually around $1,000. The prosecutor will not offer diversionary programs for second offenders because they are ineligible.
