If you have already been convicted of a Windsor DUI, you are likely familiar with the DUI process. However, this process changes depending on the number of offenses that you face. If you are facing a second offense DUI arrest, the penalties become more severe and your opportunity to use the pretrial alcohol education program probably won't be available. Learn more here.

Second offense DUIs are handled more stringently than a first-time DUI in Windsor and throughout the state of Connecticut. This is because the court and prosecution become concerned there is an underlying issue that hasn’t been addressed by the court or the individual. The court believes that since the consequences of a first DUI did not deter the person from committing a 2nd DUI, the penalties should be more severe the second time around. On this page, you can learn more about second DUI offenses and what to do if you are charged with one.

If the offender is under 21, they lose their license for three years or until they turn 21, whichever is longer. Further, the programs available to first-time DUI offenders are no longer available to people after their second. If you have already used your pretrial alcohol education program, such diversionary programs will no longer be available to you.

Additional Consequences

Second DUI offenses are not looked at as simple mistakes anymore. They are treated a bit more harshly by the courts and prosecutors due to the court thinking the person is not learning or has not addressed their personal issues. These convictions often result in some jail time, though this sentence is often suspended, meaning the person is let out. But, if there are any probation violations, the offender will be forced to serve the entire sentence. More often, there are fines and other such costs associated with this crime.

Further, convictions for this crime could have a lasting impact on employment, education, and other life-related externalities. It could impact your job or your ability to work. It can also impact your personal life and relationships with others. Because of these punishments and the serious nature of this crime, it is important to have legal representation.
