  1. Refusal to take a BAC test under any circumstance, irregardless of what vehicle was being driven at the time (this means you could be driving a personal vehicle or a commercial vehicle).
  2. Having a BAC of at least 0.04% when driving a commercial vehicle or at least 0.08% when driving any other motor vehicle.
  3. Driving under the influence of drugs or alcohol, resulting in a DUI conviction.
