Consequences of a 1st DUI

The standard punishments for a first time DUI include; six months of incarceration with a mandatory minimum of two days served, typically suspended with probation and 100 hours of community service, a fine between $500.00 and $1,000.00, and a 45 days loss of license, followed by one year of ignition interlock device installation on the vehicle(s) they drive.

Certain drivers that meet the eligibility requirements are able to take a diversionary program, which, if completed successfully, results in a dismissal of the DUI charges.

A first-time DUI offender will be directed by the court to the court division called Court Support Services, as well as the Department of Mental Health and Addiction Services, to be interviewed. These agencies then make a recommendation to the court about what is the best option for the given defendant. These departments also decide if the person is eligible for the program and if they will work with the defendant.

Under 21 Consequences For 1st DUI

As mentioned previously, those under 21 are not eligible for the program. Further, those under 18 will have their license taken by the arresting officer for a 1st time DUI in New Haven. They will not have the driver’s license returned until a guardian accompanies them to the police station and signs it out once the suspension is completed. Also, the minor, exposed to all the penalties of anyone else with a DUI, is not permitted to use youthful offender status.
